• Instrumentality
  Homings.de (hereinafter “agency”) is an instrumentality between private landlords (hereinafter referred to as “hosts”) and their tenants (hereinafter “guest”). Accommodation services are not offered by the agency. Between the guest and the agency, a booking agreement is therefore exclusively concluded by a booking, to which the regulations on §§ 651a et seq. BGB (German „Bürgerliches Gesetz Buch) (travel contract) do not apply. Landlords are not allowed to conclude additional contracts independently with already arranged customers. Should a landlord violate this rule, the agency will delete this landlord from their website and claim damages in the amount of 1000,00€.
• Booking
  The agency acts as an instrumentality on behalf of the guest. A booking will be forwarded to the host. Upon receipt of a booking confirmation, which is sent by the agency, the booking becomes mandatory. The guest will receive the address and telephone number of the host together with the booking documents by e-mail from the agency. The guest then directly connects with the host and announces the arrival time as well as a breakfast request (if offered). If required, the breakfast can be provided by the host and will be charged additionally in the booking process.
• Communication
  Between the guest and the agency can be communicated in written (letter) as well as by e-mail. The respective declarations of intent shall be legally binding in all written form.
• Payment procedures and invoicing
  The lease is concluded by the booking between the guest and the host. The host has commissioned the agency to convey his accommodation. The Agency shall compile an invoice for the guest on behalf of the host by way of the total price plus commission indicated on the website or in a separate e-mail, which depends on the amount of the final price.
  Depending on the number of guests and the booking period, the landlord charges a price for the accommodation. This will result in a full price, consisting of the price for the overnight stays (if applicable incl. VAT) and surcharges for (possibly) additionally booked facilities such as breakfast, bed sheets, towels or final cleaning (if applicable incl. VAT). The landlord and the agency agree on a price for the accommodation. In case of a successful mediation, the agency levies a commission which depends on the price of the total period.
  In case of a successful mediation, the agency will claim the agreed rent sum with the tenant (guest) and transfer the rent sum received by the tenant (guest) within 7 working days after departure to the account designated by the landlord. For accounts abroad, the duration may vary.
• Obligation to inform the Agency
  Without the intermediary of the agency, the guest may not undertake any binding legal transactions for accommodation with the host. If the guest nevertheless does so, the host is obligated to inform the agency without delay. This also applies to an extension of the originally booked stay of the guest. Violations of this can lead to a fine up to 1000,00€.
• Limitations of liability
  The content on the website of the Agency is provided by the host or in consultation with the Agency. The agency checks this to the best of its knowledge and assumes no liability whatsoever for the current state of the accommodation offered by the host. It is also not liable for the actual performance of the host.
• Referral to external pages
  We are not responsible for the contents of external websites to which we refer directly or indirectly (through “hyperlinks” or “deep links”). At the time of the linking, legal content was only visible on the linked websites. Since we do not have any influence on the contents of the linked websites, we dissociate ourselves expressly from all contents of linked websites, which were changed after the link setting. The provider of the linked pages is solely responsible for all content and, in particular, for damages resulting from the use of the information visible in the linked web pages. If we receive illegal, unlawful or incorrect content on websites that we link, we will delete the link.
